Please read these Terms and Conditions ("Terms") carefully before using the Milestone Virtual Challenges mobile application (the "App" or "Service") operated by Milestone Labs ("we", "us", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Nature of the Service

The Service is designed to motivate users through virtual badges, challenge progression, and gamified rewards based on GPS-tracked physical activity (walking). Any metrics provided by the App (steps, distance, calories) are for entertainment and motivational purposes only and should not be used for medical decision-making.

2. Eligibility and Minimum Age

You must be at least 13 years of age to use this Service. By using the App, you represent and warrant that you meet this age requirement. If you are a minor in your jurisdiction (typically under 18), you may only use the App with the consent and supervision of your parent or legal guardian.

We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will promptly delete it. If you are a parent or guardian and believe your child has provided us data, please contact us at support@milestonelabs.app.

3. Medical Disclaimer and Assumption of Risk

We do not provide medical, fitness, or health advice. Consult a physician or qualified healthcare provider before beginning any exercise program. By using the Service, you acknowledge that physical exercise carries inherent risks, and you assume all risks associated with your participation. We shall not be held liable for any physical injury, property damage, or health issues resulting from your use of the Service.

4. Accuracy of Data

The Service relies on third-party location services (GPS), device sensors, and mathematical estimations to calculate distance, speed, and calories. We make no guarantees regarding the accuracy or completeness of any data tracked by the App.

Tracking may fail or be inaccurate due to hardware limitations, GPS signal loss, software bugs, or environmental factors. We are not responsible for lost progress, incorrect measurements, unawarded badges, or data corruption.

5. Advertising

The App is supported by advertising through Google AdMob, a service provided by Google LLC. AdMob may display personalized or non-personalized ads within the App and may collect data such as your device's advertising ID to serve relevant advertisements.

By using the App, you acknowledge that ads may be displayed. Google's data collection and use of data for advertising purposes is governed by Google's Privacy Policy, available at https://policies.google.com/privacy. You can opt out of personalized ads by adjusting your device's ad settings.

6. Badges, Rewards, and Purchases

• Virtual Rewards: Virtual badges have no monetary value and cannot be exchanged for cash or other goods. We reserve the right to modify, remove, or alter virtual rewards at our sole discretion without notice or liability.
• Purchases: Any purchases made within or through the App are processed through Google Play and are subject to Google's refund policies. We reserve the right to refuse or cancel any order due to errors in pricing or availability.

7. User Accounts and Security

You must provide accurate and complete information when creating an account. You are responsible for safeguarding your sign-in credentials (e.g., Google Sign-In) and for all activity occurring under your account. We reserve the right to terminate or suspend your account immediately, without prior notice, for any breach of these Terms or for any attempt to manipulate the App's tracking systems.

8. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Milestone Labs. The App is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, modify, or create derivative works of our Service without our express written permission.

9. Limitation of Liability

In no event shall Milestone Labs, nor its directors, employees, partners, agents, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation, loss of profits, data, or goodwill — resulting from: (i) your access to or inability to access the Service; (ii) any conduct of third parties on the Service; (iii) inaccuracies in data tracking; or (iv) unauthorized access to your account. Our total aggregate liability to you shall not exceed the amounts you paid to us in the twelve (12) months preceding the claim.

10. Governing Law

These Terms shall be governed and construed in accordance with applicable law, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Effective Date" at the top of this page. By continuing to use the Service after any revisions become effective, you agree to be bound by the updated Terms.
